  Abstract

Shared concerns on high rates of International Mobile Roaming(IMR) services have been discussed throughout multiple international entities without consent on whether government regulation is effective in terms of reducing the rates. For the first time in international trade agreements CPTPP(Comprehensive and Progressive Agreement for Trans-Pacific Partnership) Members have agreed to include a article on IMR to even allow Member states to regulate wholesale rates. The purpose of this study is to review and analyze the IMR article in CPTPP especially focusing on the aspects of wholesale rates regulation and to provide implications regarding its effects on the telecommunications market of Korea. IMR articles in CPTPP indicate that Parties can regulate IMR rates to be reasonable and cooperate with each other to lower IMR wholesale rates. In addition to cooperation mechanism designed for the Parties who pursue government intervention, the CPTPP article discussed a MFN issue to minimize trade disputes. Similar to Korea where telecommunications service operators voluntarily endeavour to reciprocally reduce IMR rates, governments do not engage in regulating IMR rates in most cases. Therefore, from a short-term perspective IMR articles in trade agreements would not have dramatic effects on the market however it can be useful to have policy space for the governments to engage when it considers necessary.
